Why Cozumel

Cozumel is an island about twenty kilometres off Playa del Carmen, with its own international airport and a passenger ferry running through the day. It has one town — San Miguel — and a population that lives here year-round rather than seasonally. That single fact separates it from most of the Mexican Caribbean and shapes everything about its property market.

The island’s geography governs where anything gets built. The western, leeward side is calm and protected: the town, the ferry, the hotels and effectively all residential development sit there. The eastern, windward side faces open Caribbean surf and remains almost entirely undeveloped. The island is limestone, so most of the shoreline is ironshore rather than sand, and genuine beach exists in pockets on the south-west coast. That distinction moves prices more than any other on the island — we set out what the words actually mean here.

As a market, Cozumel behaves differently from Tulum or Playa del Carmen. There is no large speculative pipeline and no tower boom. Buyers here are mostly end users — divers who have been coming for twenty years, people retiring to somewhere with a hospital and a supermarket, families buying a second home they actually use. The upside is a market that has not been inflated by pre-construction flipping. The honest downside is that it is thinner: fewer buyers means a sale can take longer, and you should plan to hold rather than to trade.

Four settings account for nearly everything available. The malécon in town puts you on Avenida Melgar with the sea across the road and everything walkable. The south-west coast below town is where the real sand is, quieter and car-dependent. The north is jungle — the country club and low-rise homes set among trees. Two practical realities are worth building into a budget before you fall for a floor plan. Everything arrives by ferry or barge, so construction costs and timelines run higher here than on the mainland, and delivery dates slip more often than they do in Cancún. And electricity is expensive: air conditioning is the single largest running cost of an island home, which is why solar and cross-ventilation are worth more here than a finish upgrade.

Ownership & Buyer Context

Cozumel sits entirely inside Mexico’s restricted zone — the strip within 50 km of any coastline. Foreign buyers cannot hold direct title here. That is normal and it is not an obstacle; it simply means the purchase is structured one of two ways.

A fideicomiso (bank trust) is the standard route for a home. A Mexican bank holds title as trustee while you are the beneficiary, with the full right to occupy, renovate, let, sell and bequeath the property. Trusts run in 50-year terms and are renewable. Expect a setup cost and a modest annual fee, and confirm both in writing — they vary between banks.

A Mexican corporation is the alternative, and is usually the right structure only if you are buying commercially, buying several properties, or running a business from the asset. It carries ongoing accounting and filing obligations that a trust does not.

The transaction itself is executed by a Notario Público — a senior public official, not your representative. The notario verifies title, calculates and withholds taxes and registers the deed. Because they act for the transaction rather than for you, many foreign buyers also retain an independent attorney, which we would encourage.

Budget roughly 5–8% of the purchase price for closing costs, paid by the buyer. The largest single component is the acquisition tax, with notario fees, registration, the trust permit and the bank’s trust setup making up the rest. Annual property tax (predial) is very low by North American standards. On resale, capital gains tax applies, with exemptions available in some circumstances for a primary residence — the conditions are specific, so establish where you stand before you sell rather than after.

Two checks are worth insisting on. Confirm the property is not ejido land, which cannot be sold as private property until it has been formally regularised. And obtain a certificado de libertad de gravamen, the no-lien certificate, so you know what the title carries. For a condominium, also read the régimen de propiedad en condominio and ask who administers the building and what the fee covers.
